Title: The Destitution of Citizenship: Crises of Democracy and the Radical Critique of the State

Abstract: Observers of the “mature” liberal democracies are struck by the downward spiral in many countries today whereby the arrival of rising numbers of migrants has been seized upon by populists and authoritarians to mobilize fearful voters. Rather than cause and effect, observers suggest that both phenomena result from deeper shifts within national and global structures that have undermined democratic politics. On this view, the desperate migrant and the fearful voter are twin results of a mutation of citizenship, and in particular of its reduction to a status, eagerly sought by one group and jealously guarded by the other.

In this presentation I focus on a perspective that has arisen in legal and political theory to diagnose and possibly also to respond to this process. This perspective revolves around the idea of “destitution”, understood as the inverse of the classically modern notion of the sovereign people as pouvoir constituant. I trace this idea from Foucault to more recent Italian political philosophy and German legal theory as well as in contemporary activist communities. I argue that today this perspective tends to assume two dominant forms, one positive, the other negative. Both versions grasp the contemporary crisis of citizenship as a crisis of sovereignty and community, but they go on to draw very different practical lessons. This theoretical alternative sheds light on an important divide within radical politics between anarchism and radical democracy, a politics of exodus and a possible reconstitution of citizenship.

2017 Chet Mitchell Memorial Award Recipient Announced!

Congratulations to M.A. Legal Studies candidate, Jean Ketterling, this year’s recipient of the ! The award was presented at the 12th Annual Ӱԭ Graduate Legal Studies Association Conference, during FPA Research Month. Jean’s research is currently focused on how players understand violence in video games and the relationship between feminist debates on pornography and video games.

Ӱԭ the Award

Established in 1991 by colleagues, family, and friends in honour of the late Chet Mitchell, who was a professor in the Department of Law and Legal Studies. This award is given annually to a deserving student enrolled in the Master of Arts program in legal studies.

The Game of Law: Rules, Fools, and Cheats

Canada’s adversarial legal system features two parties in contest with one another. One way of viewing this system is as a game bound by a series of rules. These rules regulate not only individual players such as the Judge or the Crown, but society more broadly. As with all games, there are those who follow the rules and those who break them. We would like to take this opportunity to invite interdisciplinary proposals to analyze and discuss the many auspices of law and its game-like nature. How can the metaphor of a game aid us in thinking outside the box on legal, political, and social problems? How does understanding individuals as pieces in a larger game impact our understanding of governing subjects, their subjective experiences, and the affects of the law more broadly? What parallels can be drawn between seeing law as a game and aspects of criminalization and justice?

To facilitate this interdisciplinary exchange we encourage participants from a wide variety of disciplinary backgrounds to play a round with us by presenting on the similarities between games and law and the players involved in them. Paper topics may include, but are not limited to:

  • Games as allegory (Monopoly, Clue, Papers Please, Her Story, etc.)
  • Socio-legal analysis of video, board, or any other medium of games
  • Making and breaking rules
  • Playing with representations of crime, criminals, and justice
  • Advocacy, solidarity, playmates, and queer theory
  • Unboxing international law
  • Policing and the enforcement of rules
  • Games of governance and regulation
  • Ludonarative dissonance and affect in games of law

Submission Guidelines
Please include a paper title, an abstract with a maximum of 250 words, and up to five keywords that best describe your proposed presentation. Be sure to also include your full name, institutional affiliation, email address, and a brief background of yourself. Presentations will be allocated 15 minutes with a brief question period at the end of each panel. Please email your abstract in doc/docx format to either megan.longergan@carleton.ca or garrett.lecoq@carleton.ca with [The Game of Law] in the subject line on or before February 20th 2017. Organizers will indicate whether your paper has been accepted within a couple of weeks after the deadline.

In Thanks to Our Community

On Wednesday, January 18th, the Department of Law and Legal Studies marked the launch of its 50th anniversary, coinciding with Ӱԭ’s 75th anniversary celebrations. In 1967, the Department of Law and Legal Studies emerged as the first unit in Canada to study law within an interdisciplinary context. Since then, it has grown to offer the largest and most extensive undergraduate and graduate programs in legal studies in the country. The anniversary launch reception was held on campus with department staff, faculty, contract instructors, students, alumni, and esteemed guests gathering to pay tribute to fifty years of excellence and innovation.

As guests mingled, the Ӱԭ University Law and Legal Studies Society (CULLSS) released its latest issue of the Ӱԭ University Journal of Legal Studies. President Roseann O’Reilly Runte was also in attendance to reflect on the department’s achievements with a few opening remarks. Shortly thereafter, she welcomed to the stage a special guest, Right Honourable Beverley McLachlin, Chief Justice of Canada, who imparted her best wishes for the Department’s continued success.

In honour of this important milestone in the history of the Department, Chair Ron Saunders announced a fundraising campaign towards commemorative scholarships for undergraduate and graduate students in law programs at Ӱԭ.

The Department wishes to extend gratitude to its guests for joining the celebrations, and to the Ӱԭ community and beyond for its ongoing support.

The Department of Law and Legal Studies is celebrating its 50th Anniversary this year!

In 1967, the Department of Law and Legal Studies emerged as the first unit in Canada to study law within an interdisciplinary context. Since then, it has grown to offer the largest and most extensive undergraduate and graduate programs in legal studies in the country.

To mark the launch of its 50th anniversary celebrations this year, the Department is hosting a special reception on campus on the afternoon of January 18, where past and current department staff, faculty, contract instructors, students, alumni, and other esteemed guests will be present to join in recognizing 50 years of innovation and excellence. President Roseann O’Reilly Runte will be in attendance to honour the department’s achievements with a few opening remarks, followed by a warm welcome from the Chair of the department, Prof. Ron Saunders.

Congratulations to recent MA graduate, David Meinen, who has been named a recipient of a 2016 Senate Medal for Outstanding Academic Achievement!

David’s thesis entitled, “Pacification through humanitarian aid: Examining Canada’s security-development role in Haiti”, was completed under the supervision of Prof. George Rigakos, with support from second reader Prof. Dominique Marshall and external examiner Prof. Augustine Park. Ӱԭ University will present David with his medal at the Fall convocation to formally commend his outstanding academic achievement.

The discussion event offered the opportunity for attendees to review a copy of the draft, to learn about the context of the policy process, and to share questions and concerns regarding both the document and the process.
